Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Astral Warden, LLC (“Astral Warden”, “we”, “us”), and govern your use of our website, apps, and monitoring agent (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

Astral Warden is a monitoring tool for remote astrophotography rigs. A read-only agent you install on your imaging computer observes your system, software, and equipment and reports a normalized picture to our cloud, where you can view status and data quality and receive alerts. The agent does not control your equipment or write to your systems.

2. Your account

You must provide accurate information and are responsible for activity under your account and for keeping your credentials secure. You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Service. Notify us promptly of any unauthorized use.

3. Installing the agent

You may install and run the agent only on computers you own or are authorized to monitor. You are responsible for your equipment, your capture software, your imaging pipeline, and your arrangements with any hosting facility. The agent is provided to observe and report; you consent to it reading from the sources you configure.

4. Subscriptions, billing, and trials

• Paid plans are billed per rig through our merchant of record, Polar, which handles payment and applicable taxes.
• Free trials convert to a paid subscription only if you choose to subscribe; we describe trial terms at sign-up.
• Subscriptions renew automatically for the billing period you selected until you cancel. You can cancel at any time; access continues until the end of the current period.
• Except where required by law, payments are non-refundable. Refund and cancellation handling is provided through Polar.
• We may change prices or plans on reasonable notice; changes apply to future billing periods.

5. Acceptable use

You agree not to:

• Use the Service to monitor systems you don't own or aren't authorized to monitor.
• Reverse-engineer, resell, or attempt to disrupt or gain unauthorized access to the Service.
• Use the Service unlawfully or to infringe others' rights.
• Interfere with the integrity or performance of the Service or the networks behind it.

6. Your content and data

You retain ownership of your data and images. You grant us the limited rights needed to operate the Service (for example, to store and display the telemetry and metadata your agent sends and to deliver your alerts). Our handling of personal data is described in our Privacy Policy.

7. Third-party services

The Service works alongside third-party software and providers (for example NINA, Voyager, your mount and camera vendors, and your hosting facility). We aren't responsible for those products or services, and your use of them is governed by their own terms.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Astral Warden is a best-effort monitoring aid, not a guarantee. We do not warrant that the Service will detect every problem, that every alert will be generated or delivered, or that it will be uninterrupted or error-free. It is not a safety, security, or life-critical system. You remain solely responsible for your equipment, your imaging, and your data, and you should not rely on the Service as your only safeguard.

9. Limitation of liability

To the maximum extent permitted by law, Astral Warden will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost imaging time, lost data, lost profits, or equipment damage, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

10. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or others. On termination, your right to use the Service ends; certain sections (including Disclaimers, Limitation of Liability, and the data-handling described in our Privacy Policy) survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules, and any disputes will be subject to the state and federal courts located in Georgia, unless otherwise required by applicable law.
